Procedures and Principles Established for Unlicensed Electricity Generation Facilities That Have Completed Their Ten-Year Support Period

Resolution of the President No. 11415 (Resolution) entered into force upon its publication in the Official Gazette dated 13 June 2026 and numbered 33279. The Resolution sets forth the price applicable to surplus electrical energy generated by electricity generation facilities that continue to operate under the unlicensed generation regime pursuant to Article 14 of the Electricity Market Law No. 6446 following the expiration of their ten-year Renewable Energy Resources Support Mechanism (YEKDEM) support period, as well as the procedures and principles governing the implementation thereof.

The Resolution applies to electricity generation facilities that continue to engage in unlicensed generation activities based on renewable energy resources within the scope of Article 6 of Law No. 5346 on the Utilization of Renewable Energy Resources for the Purpose of Generating Electrical Energy (Law No. 5346).

The principal regulations introduced by the Resolution are summarized below:

  • It has become possible for all electrical energy generated by unlicensed electricity generation facilities located at the same metering point as the consumption facility to be sold.
  • For unlicensed electricity generation facilities located at a different metering point than the consumption facility, only surplus electrical energy may be sold.
  • The amount of surplus electrical energy that may be sold shall be determined by the Energy Market Regulatory Authority.
  • Electrical energy supplied to the system more than the determined surplus amount shall be deemed a free-of-charge contribution to YEKDEM.
  • In the event that surplus electrical energy is supplied to the transmission or distribution system, the purchase price applicable to the electrical energy supplied to the system following hourly settlement shall be calculated as 90% of the current YEKDEM price applicable to licensed generation facilities under Article 6 of Law No. 5346, determined on a facility-type basis and rounded to two decimal places. However, such price may not exceed the hourly market clearing price (MCP) formed in the electricity market.
  • Electrical energy eligible for sale must be purchased by the relevant designated supply company; such purchased electrical energy shall be deemed to have been generated and supplied to the system within the scope of YEKDEM.
