The Regulation Amending the Regulation on Commercial Advertising and Unfair Commercial Practices Has Been Published
Pursuant to the Regulation Amending the Regulation on Commercial Advertising and Unfair Commercial Practices (“Amending Regulation”) published in the Official Gazette dated 01.02.2022 and numbered 31737, the Regulation on Commercial Advertising and Unfair Commercial Practices (“Regulation”) has been amended.
Significant amendments introduced by the Amending Regulation are summarized below:
- The rule providing that advertisements cannot contain expressions or images of patients before and after medical treatments is repealed.
- A new regulation is introduced regarding the personalized prices offered to consumers by analyzing their purchasing behavior and other personal data.
- With regard to the discount sales advertisements, the principles on the determination of the undiscounted sales prices are set.
- For the advertisements in which a good or service is advertised with a bundled loan, it is regulated that the advertisement or a link in the advertisement shall include the conditions of the loan.
- Biocidal products are listed among the goods or services with special regulations regarding advertisements.
- For the goods and services that are sold online, it became mandatory to provide information on their ranking criteria, and to include the word “advertisement” in the search results displayed based on a sponsorship or a similar agreement.
- The principles on the publication of consumer reviews and consumer complaints are determined. Within this context, consumer evaluations can be solely made by those who actually purchased the relevant good or service. In addition, it is prohibited to enter into an agreement to make inaccurate evaluations or to use confirming expressions for a good or service to increase its sales.
The Amending Regulation will enter into force on 01.03.2022
